Marvell AQC113 - Nicgiga card

I did some searching and only could find reference to the AQC113c card on this forum. I have purchased 2 of these cards off of amazon and neither one of them work in a MSi X670-p Pro motherboard in PCIe_4 . Cpu is 7800x3d . I do have it show up in the device manager , and I have installed the public drivers from the Marvell website (Windows 11 Pro) . What happens is the port just "bounces" and never really connects. I have tried DHCP and static address and nothing seems to work. The Nicgiga 8-port 10g switch , Asus router , and linksys 8 port switches all had the same result. I tried the cables on my 2 servers and the sync up just fine.

The comment I did find here stated the AQC113c was discontinued due to a bug , was this the bug? Maybe I am missing something because I have never installed a 10g nic in a Windows machine before.

Any help would be awesome.Thanks

further update , bios flashback to old bios , no good. tested nic cards in other pc's , well that worked flawless every time , MSi B650 Pro and on older Asus Hero (Intel 9900k) and both worked fine and didn't need to install drivers. So its seems to be slot number 4 on the Msi X670-P motherboard that is to blame. I was unable to effect any change with bios settings , forced the slot to Gen 3( thats the B650 slots speed that worked) enabled and disabled and reflashed a few different bioses. the only real luck I had , was using a Fedora Workstation live usb and I was able to get it to connect and stay connected , but it only downloaded at 15mb /s and upload 1mb/s so not what i would call working. I need to try another slot on the motherboard but that requires a complete rebuild and I need to find a smaller gpu so I can get to it. Just doesn't make sense

Just to verify ...
The PCI_E4 have lanes v( 4.0 ) from the chipset and is x2.
If the M2_4 slot is occupied the PCI_E4 will be disabled. ( shared lanes )

Yes , the manual states that its one or the other , the board has 4 M2 slots , and M2_4 is directly above PCIe_4 , and has never had an nvme in it. M2_1,M2_2 and M2_3 Normally have nvme's. I did even remove slot 2 and 3 to see if that would make a difference and it didn't.
