Trying to decide between these two on ebay - which is the better drive for a workstation, assuming price I can get the 3710 for close to the Samsung.

The Intel may be the faster one but I doubt its relevant for a workstation.
I would prefer an NVMe like Samsung 950 or Intel P7500

But as I understand it i can't boot off NVME on 1366 since it requires a UEFI BIOS to boot. Or am wrong?

I suppose uefi is not the problem.
It may boot on older boards or not, see
Intel SSD 750 PCIe SSD Review: NVMe for the Client

If it won`t boot, you may add a small ssd as bootdevice with a Windows setup on NVMe or you can use it as datadrive for your data. A little more complicated but in the end NVMe is much faster than an SSD, more like a raid-0 of 3-4 SSDs.

But you need a use case like video or image editing to "feel" the difference.
